Participant Liability Waiver, Assumption of Risk & Media Release

Event: Battle of the Best
Location: SeaWorld San Antonio, Texas

RELEASE OF LIABILITY

In consideration for being permitted to participate in Battle of the Best (“Event”), I, the undersigned participant, and/or the parent/legal guardian of the participant if under eighteen (18) years of age, voluntarily agree to the following:

I understand that dance, choreography, tumbling, acrobatics, stage performances, rehearsals, travel, and related activities involve inherent risks, including but not limited to:

  • Falls
  • Collisions with other participants
  • Slips or trips
  • Equipment malfunction
  • Physical exertion
  • Sprains, strains, fractures
  • Permanent disability
  • Illness
  • Death

I voluntarily assume all risks associated with participation in the Event.

MEDICAL AUTHORIZATION

I certify that the participant is physically able to participate.

I understand that Battle of the Best does not provide medical insurance.

In the event of an emergency, I authorize Event staff to obtain emergency medical treatment deemed necessary.

I understand that all medical expenses remain my sole responsibility.

RELEASE OF CLAIMS

To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue:

  • Battle of the Best
  • Battle of the Best
  • SeaWorld San Antonio
  • Any Event venue
  • Event staff
  • Judges
  • Volunteers
  • Sponsors
  • Vendors
  • Contractors
  • Employees
  • Independent contractors
  • Officers
  • Directors
  • Representatives
  • Agents
  • Successors and assigns

from any and all liability, claims, damages, injuries, losses, costs, attorney’s fees, or causes of action arising out of participation in the Event, including those resulting from ordinary negligence.

This release applies before, during, and after the Event.

PROPERTY DAMAGE

I accept full responsibility for any property damage caused by the participant.

I agree to reimburse the Event or venue for damages resulting from negligent or intentional acts.

CODE OF CONDUCT

Participants, coaches, parents, and guests agree to:

  • Demonstrate good sportsmanship.
  • Treat judges, staff, volunteers, competitors, and venue employees with respect.
  • Follow all Event rules.
  • Follow all SeaWorld policies.
  • Follow directions from Event personnel.
  • Maintain appropriate behavior at all times.

Battle of the Best reserves the right to remove any participant, coach, or spectator whose behavior is unsafe, disruptive, abusive, or unsportsmanlike.

No refund will be issued if removal occurs due to misconduct.

PERSONAL PROPERTY

Battle of the Best is not responsible for:

  • Lost items
  • Stolen property
  • Damaged costumes
  • Props
  • Cell phones
  • Jewelry
  • Electronics
  • Personal belongings

Participants are solely responsible for securing their personal property.

MEDIA RELEASE

I grant Battle of the Best and the contracted event media vendors permission to photograph, record, livestream, videotape, and otherwise capture the participant’s image, voice, likeness, routine, interview, and performance.

I understand these materials may be used for:

  • Advertising
  • Social media
  • Television
  • Streaming
  • Marketing
  • Promotional materials
  • Future Event promotions
  • Printed publications
  • Websites

I waive any right to inspect or approve these materials.

I understand no compensation will be provided for such use.

PHOTOGRAPHY & PERSONAL MEDIA

I acknowledge that Battle of the Best permits attendees to take personal photographs and videos during the Event.

Professional photography and media packages may also be offered through the Event’s official media provider.

RULES & DECISIONS

I understand:

  • Judges’ decisions are final.
  • Event schedules may change.
  • Divisions may be combined, split, or modified.
  • Awards may be adjusted due to participation levels.
  • No refunds will be given for any reason.
  • Failure to comply with Event rules may result in disqualification without refund.

COVID / COMMUNICABLE ILLNESS ACKNOWLEDGMENT

I understand participation in public events may expose participants to communicable illnesses.

I voluntarily assume all such risks and release the Released Parties from liability relating to illness exposure except where prohibited by law.

INDEMNIFICATION

I agree to defend, indemnify, and hold harmless Battle of the Best, SeaWorld San Antonio, and all Released Parties from any claims, damages, liabilities, expenses, or attorney’s fees arising from the participant’s actions or participation in the Event.

GOVERNING LAW

This Agreement shall be governed by the laws of the State of Texas.

Any legal action shall be brought exclusively in the appropriate courts located in the State of Texas.

ACKNOWLEDGMENT

I certify that:

  • I have carefully read this entire Agreement.
  • I fully understand its contents.
  • I understand I am giving up substantial legal rights.
  • I sign this Agreement voluntarily and without coercion.
  • I have authority to sign on behalf of the participant if he or she is under eighteen (18).
